Legal review notice
This policy describes Fapple's current practices. It is not legal advice, is not described as attorney-reviewed, and does not guarantee compliance. Qualified legal counsel should review the service and these terms as the product and geographic availability change.
Reporting copyright concerns
Use the copyright complaint form at /legal/dmca/takedown or email admin@fapple.org. This is the currently published copyright contact for Fapple, an unincorporated New Jersey project. Do not send passwords, identity documents, or unrelated sensitive information.
What a complaint should include
Provide a physical or electronic signature; identify the copyrighted work; identify the allegedly infringing material and the exact Fapple URL; provide contact information; state your good-faith belief that the use is not authorized by the owner, agent, or law; and state that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right.
Incomplete notices may require follow-up. Knowingly material misrepresentations may create legal consequences.
Review and removal process
Fapple records the submission time and reference, reviews whether the notice identifies material that can be located, may request clarification, and may restrict or remove material while reviewing the claim. Fapple may notify affected parties where appropriate and preserve limited records needed to manage the complaint.
Counter-notices
Where legally available, an affected party may use /legal/dmca/counter-notice. A counter-notice should include the legally required statements, contact information, consent to appropriate jurisdiction, and signature. Restoration, if any, occurs only after review and applicable waiting periods.
Repeat infringement
Fapple does not knowingly permit infringing content. Substantiated complaints may result in removal, restrictions, strikes, or account termination. Fapple considers context and valid counter-notices when applying its repeat-infringer policy.
Designated-agent status
Fapple does not state that it has registered a DMCA designated agent with the U.S. Copyright Office. Online service providers seeking 17 U.S.C. section 512 safe-harbor protection generally must publish agent information, register it with the Copyright Office, keep it current, and renew at least every three years. Fapple should obtain counsel and complete registration if it intends to rely on that safe harbor.
